These Terms and Conditions (“Terms”) govern your access to and use of the WarriorBabe website, mobile applications, portals, forms, content, communications, products, memberships, programs, telehealth-related access points, and related services made available under the WarriorBabe brand (collectively, the “Services”). By accessing, browsing, registering for, purchasing from, enrolling in, or otherwise using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
For purposes of these Terms:
1. “WarriorBabe,” “Company,” “we,” “us,” and “our” refer to Alpha Female Fitness, LLC d/b/a WarriorBabe and WarriorBabe Health, LLC, as applicable, and the WarriorBabe-branded platform, technology, communications, coaching, education, support, coordination, and related service operations.
2. Clinical telehealth services made available through the WarriorBabe experience are provided by licensed clinicians practicing through Dynamic Health Institute LLC, doing business as Dynamic Health Institute, and/or other affiliated medical groups or licensed providers, where applicable.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services unless a parent or legal guardian has lawfully enrolled or consented on your behalf. By using the Services, you represent and warrant that you meet these eligibility requirements and that the information you provide is accurate and complete.
WarriorBabe offers a range of consumer-facing services that may include wellness education, lifestyle content, coaching, memberships, community access, support services, scheduling tools, intake tools, communications, product offerings, and access points for telehealth-related services. Some Services are non-clinical in nature, and some may facilitate access to clinical telehealth services delivered by licensed medical providers.
WarriorBabe is not a hospital or emergency service provider. WarriorBabe’s non-clinical services, including coaching and educational content, are not medical advice and are not a substitute for diagnosis, treatment, or care from a licensed healthcare professional.
Where medical or telehealth services are offered through the WarriorBabe experience, those services are provided by licensed clinicians practicing through Dynamic Health Institute LLC or other affiliated medical groups or licensed providers, as applicable. WarriorBabe facilitates the consumer-facing experience, including scheduling, communications, onboarding, support, and related administrative functions, but does not itself practice medicine unless expressly stated otherwise in a separate clinical agreement.
You understand and agree that:
• Clinical decisions are made solely by the treating licensed provider.
• Access to the WarriorBabe platform does not guarantee that you will receive a diagnosis, prescription, lab order, treatment plan, or any particular clinical outcome.
• Your ability to receive clinical services depends on provider availability, state licensure, clinical appropriateness, and other legal or medical limitations.
The Services are not intended for emergencies. Do not use the Services for urgent or life-threatening conditions. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. If you are experiencing a mental health crisis or thoughts of harming yourself or others, call 988 or seek emergency help immediately.
To access certain portions of the Services, you may be required to create an account, complete intake forms, provide payment information, or otherwise provide personal information. You agree to:
• Provide current, accurate, and complete information.
• Maintain and promptly update your information.
• Keep your login credentials confidential.
• Notify WarriorBabe promptly of any unauthorized access to your account.
You are responsible for all activity occurring under your account unless prohibited by law.
By using the Services, you consent to receive electronic communications from WarriorBabe and, where applicable, affiliated clinical providers, including by email, SMS, phone, app notification, or secure portal message, subject to applicable law and your communication preferences. These communications may include appointment confirmations, care-related follow-ups, billing notices, policy updates, transactional notices, and marketing communications where permitted and consented to.
You understand that message and data rates may apply and that you may opt out of certain non-essential communications as provided in the applicable communication or privacy settings.
Your use of the Services is also governed by the WarriorBabe Privacy Policy, Notice of Privacy Practices, and any applicable Telehealth Consent, which are incorporated into these Terms by reference. If you use or access telehealth or clinical services, your information may be collected, used, disclosed, and protected as described in those documents and in accordance with applicable law.
If there is a conflict between these Terms and the Notice of Privacy Practices regarding protected health information, the Notice of Privacy Practices controls.
Some Services are offered for a fee, including memberships, coaching programs, subscriptions, consultations, lab-related services, products, and other offerings. By purchasing any paid Service, you agree to pay all applicable fees, taxes, shipping charges, renewal charges, and other amounts disclosed at checkout or in your service agreement.
You understand and agree that:
• Some programs may involve minimum commitment periods or recurring billing.
• Some offerings may be self-pay and not reimbursable by insurance.
• Charges may be processed using the payment method you provide, consistent with the Financial Responsibility and Payment Authorization document.
Refunds, cancellations, renewals, pauses, rescheduling, and no-show terms may vary by product or service and are governed by the terms presented at purchase, in applicable checkout flows, and in separate policy documents where provided.
WarriorBabe reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, to the extent permitted by law. Availability of particular services, providers, products, labs, medications, or programs may vary based on geography, licensure, inventory, clinical appropriateness, and operational constraints.
You agree not to:
• Use the Services in violation of any applicable law or regulation.
• Impersonate another person or provide false information.
• Interfere with the operation or security of the Services.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Use the Services to harass, abuse, threaten, or defraud others.
• Copy, scrape, reverse engineer, reproduce, distribute, or exploit the Services or content except as expressly permitted.
WarriorBabe reserves the right to suspend or terminate access to the Services for violations of these Terms or for conduct that creates legal, operational, safety, or reputational risk.
All content, branding, text, graphics, software, videos, educational materials, workflows, designs, and other materials made available through the Services are owned by WarriorBabe or its licensors and are protected by intellectual property laws. Except as expressly permitted, no content may be copied, modified, distributed, republished, sold, licensed, or exploited without prior written permission.
WarriorBabe does not guarantee any specific health, wellness, weight, hormone, symptom, physique, lab, or treatment outcome from use of the Services. Individual results vary based on personal history, adherence, biology, lifestyle, provider judgment, and other factors.
Any testimonials, success stories, before-and-after descriptions, or educational examples are illustrative only and do not guarantee that you will achieve similar results.
The Services may contain or rely on third-party tools, vendors, websites, payment processors, pharmacies, labs, shipping partners, communication vendors, or external links. WarriorBabe is not responsible for the content, availability, privacy practices, pricing, or performance of third-party services except as required by law.
Your use of third-party products or services may be subject to separate terms and privacy policies.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Nothing in these Terms is intended to limit rights that cannot be disclaimed under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARRIORBABE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF WARRIORBABE FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO WARRIORBABE FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Some states do not allow certain limitations of liability, so portions of this section may not apply to you.
You agree to defend, indemnify, and hold harmless WarriorBabe and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, liabilities, damages, losses, judgments, awards, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
• Your use or misuse of the Services.
• Your violation of these Terms.
• Your violation of any law or the rights of another person.
• Information or content you submit through the Services.
WarriorBabe may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, for violation of these Terms, suspected fraud, nonpayment, safety issues, legal risk, misuse of the Services, or other operational reasons, to the extent permitted by law.
You may stop using the Services at any time, but termination of use does not eliminate obligations already incurred, including payment obligations, consent validity for services already rendered, or any provisions of these Terms that by their nature survive termination.
Any arbitration, class action waiver, jury trial waiver, forum selection clause, or governing law provision should be reviewed and approved by legal counsel before implementation, especially given the telehealth, multistate, consumer, subscription, and clinical-service context.
Until legal finalizes this section, WarriorBabe reserves the right to specify dispute resolution procedures in a revised version of these Terms.
WarriorBabe may revise these Terms from time to time. When changes are material, WarriorBabe will update the “Last updated” date and may provide additional notice through the website, portal, email, or other electronic means.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.
